1. Acceptance of Terms

Welcome to TypoSentry. These Terms of Service ("Terms") govern your access to and use of the TypoSentry website, applications, and services (collectively, the "Service") provided by Kamino Holdings, LLC, a Delaware limited liability company ("Company," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

TypoSentry is a website copy monitoring service that scans websites for typos, grammar issues, placeholder content, and other copy errors. The Service includes:

• Automated website scanning and analysis
• AI-powered error detection and suggestions
• Email reports and notifications
• Dashboard for viewing and managing issues
• Integration with third-party services (e.g., Linear, GitHub)
• Screenshot capture for issue verification

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or no longer current, or if you violate these Terms.

4. Subscription and Billing

4.1 Subscription Plans

The Service is offered through various subscription plans with different features and pricing. Details of available plans are provided on our pricing page. We reserve the right to modify our plans and pricing at any time with reasonable notice to existing subscribers.

4.2 Payment Terms

Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. All payments are processed through our third-party payment processor (Stripe). By providing payment information, you authorize us to charge your payment method for all fees incurred.

4.3 Refunds

Subscription fees are generally non-refundable. However, if you are unsatisfied with the Service within the first 14 days of your initial subscription, you may request a full refund by contacting us at hi@typosentry.com. Refunds for annual subscriptions may be prorated at our discretion.

4.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation, your subscription will remain active until the end of your current billing period, after which you will lose access to paid features.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to scan websites you do not own or have authorization to scan
• Attempt to gain unauthorized access to any part of the Service or its systems
• Use the Service to violate any applicable laws or regulations
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated means to access the Service except through our provided APIs
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to transmit viruses, malware, or other malicious code
• Resell, sublicense, or provide the Service to third parties without our written consent
• Use the Service in any manner that could damage, disable, or impair the Service

6. Website Scanning Authorization

By adding a website to your TypoSentry account, you represent and warrant that:

• You own the website or have explicit authorization from the website owner to scan it
• The scanning of the website does not violate any agreements you have with third parties
• You accept responsibility for any issues arising from the scanning of the website

We may also conduct limited scans of publicly accessible websites to identify copy issues and to introduce the Service to prospective customers. These scans are limited in scope and intended for outreach and demonstration purposes.

Our scanner identifies itself via the User-Agent string "TypoSentry Bot/1.0". We make reasonable efforts to minimize the load on scanned websites and do not attempt to bypass access controls or authentication. We may read robots.txt to discover sitemap locations, but we do not guarantee compliance with all robots.txt directives. If you want us to stop scanning a website, contact us at hi@typosentry.com and we will make reasonable efforts to honor your request.

7. Intellectual Property

7.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by Kamino Holdings, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

7.2 Your Content

You retain ownership of any content you submit to the Service. By using the Service, you grant us a limited license to access, process, and store content from your websites solely for the purpose of providing the Service. This license terminates when you delete your account or remove a website from your account.

8. Third-Party Services

The Service may integrate with or contain links to third-party services (e.g., Linear, GitHub, Stripe). Your use of such third-party services is governed by their respective terms and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services.

9. Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) the results obtained from the Service will be accurate or reliable; (c) the Service will meet your requirements; or (d) any errors in the Service will be corrected.

The Service uses AI-powered analysis which may produce false positives or miss certain errors. You are responsible for reviewing and verifying all suggested corrections before making changes to your website.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL KAMINO HOLDINGS, LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to defend, indemnify, and hold harmless Kamino Holdings, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your use of the Service caused damage to a third party.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by canceling your subscription and deleting your account through your account settings or by contacting us. Upon termination, we will delete your account data in accordance with our Privacy Policy, except as required to comply with legal obligations.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Delaware, and the decision of the arbitrator shall be final and binding.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the changes becoming effective. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kamino Holdings, LLC regarding the Service and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of such provision or our right to enforce it later.

16.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
